By accessing this website, booking a session, or purchasing services from Erica Shaye Pilates, LLC (the “Studio”), you agree to the following Terms + Conditions.
SERVICES
The Studio provides private, one-on-one Pilates and apparatus-based movement instruction in Frisco, Texas. Services may include single sessions, 5-Session Series, 10-Session Series, Contrology sessions, ESP sessions, and related private offerings. All services are appointment-based and subject to availability.
PAYMENT
All sessions and series are billed in advance. Payment is required at the time of booking or purchase. Prices may change at any time; purchases already completed will be honored according to the price and terms disclosed at purchase. All purchases are non-transferable and have no cash value.
SESSION SERIES
A 5-Session Series or 10-Session Series provides access to a defined number of private sessions within the expiration period disclosed at purchase. Series support continuity and progression; they are not memberships, subscriptions, or automatically renewing contracts unless expressly stated in writing. Unused sessions expire according to the terms disclosed at purchase.
CONTINUITY PRICING
The Studio may honor a client’s prior series rate when the client maintains continuous series activity by purchasing a new 5-Session Series or 10-Session Series within fourteen (14) days after the prior series is completed or expires. Continuity Pricing applies only to the same client, same account, and consecutive series purchases. It is non-transferable, has no cash value, and may not be applied retroactively. If a client goes six (6) months or more without an active paid series, prior pricing is forfeited and any future purchase is subject to the Studio’s then-current rates. The Studio may modify or discontinue Continuity Pricing upon written notice, except for series already purchased and paid in full.
CANCELLATIONS, LATE CANCELLATIONS + NO-SHOWS
Sessions must be canceled or rescheduled at least twelve (12) hours before the scheduled appointment time. Sessions canceled with fewer than twelve (12) hours’ notice, or missed without notice, are forfeited and treated as completed. Late-canceled or missed sessions are not refunded, credited, or rescheduled. The Studio may make a written exception at its sole discretion; an exception in one instance does not alter the policy or create an entitlement to future exceptions.
LATE ARRIVALS
A late arrival does not extend the scheduled appointment. The session will end at the original end time so the Studio can preserve the appointments that follow. If the remaining time is not sufficient for safe or meaningful participation, the Studio may treat the appointment as a completed session.
STUDIO CANCELLATIONS
If the Studio must cancel a session, the session will be returned to the client’s account or rescheduled without penalty. When appropriate, the Studio may extend the affected package expiration date so the cancellation does not reduce the client’s opportunity to use the purchased session.
EXPIRATION + EXTENSIONS
Single sessions and Session Series expire according to the expiration terms disclosed at purchase. Expired sessions are ordinarily forfeited and are not refunded, credited, or transferred. The Studio may approve a written extension at its sole discretion when circumstances warrant. An approved extension applies only to the sessions and dates identified in writing and does not modify the terms of any other purchase.
ILLNESS + PARTICIPATION
Clients should not attend when experiencing a contagious illness or when participation would be unsafe. The standard cancellation policy remains applicable unless the Studio confirms an exception in writing. The Studio may modify, pause, or decline a session when participation appears inappropriate or unsafe.
HEALTH SAFETY + SCOPE
Pilates and apparatus-based movement involve physical activity and inherent risk. By participating, you represent that you are able to participate and that you have consulted a licensed healthcare provider as needed. The Studio provides Pilates instruction, corrective exercise-informed movement education, and private training. Services are not medical care, physical therapy, diagnosis, or treatment. You agree to disclose relevant injury, pregnancy, medical condition, limitation, pain, medication effect, or change in health status that may affect participation and to communicate promptly if anything feels unusual or concerning.
ASSUMPTION OF RISK + RELEASE
Participation is also governed by the Studio’s separate Waiver, Release of Liability & Indemnity Agreement. If these Terms and the signed waiver address the same subject, the signed waiver controls to the extent permitted by law.
COMMUNICATIONS
The Studio may contact clients regarding bookings, scheduling, waitlists, forms, account information, transactions, and changes affecting purchased services. Marketing communications are optional and may be declined or unsubscribed from at any time.
WEBSITE USE
Website content is provided for informational purposes only. Copy, images, method language, branding, and materials on this website are owned by Erica Shaye Pilates, LLC or used with permission and may not be copied, reproduced, or used without written consent.
POLICY CHANGES
The Studio may update these Terms + Conditions prospectively. Material changes affecting a completed purchase will not retroactively reduce the sessions or expiration period already disclosed for that purchase. Continued use of the website or a new booking or purchase after updated terms are posted constitutes acceptance of the revised terms for that future activity.
GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of Texas. Venue for any dispute shall be in Collin County, Texas.
